On the Arizona Immigration Law

The latest craze on Facebook seems to be joining groups about your racist, homophobic, and woman hating political views. This makes for great fun when I go through my newsfeed and have to constantly fight to hold back my passive aggressiveness (hell, my aggressiveness entirely).

Here’s the deal, regarding the Arizona Immigration Law. This is an example of the old white man sitting up there making decisions for the rest of America. And a whole bunch of ignorant people not thinking of the big picture who are nodding in agreement. Who are you to decide what is offensive against people you do not identify with at all?

Let’s speak in truths here, and not with opinions.

1) This country is BUILT on immigration. Your ancestors are most certainly immigrants, and not all of them legally. GTFO?

2) The most common group I see people join is “It’s not RACISM, you people are here ILLEGALLY”. The entire point (which people seem to be missing completely) is that it is BLATANT racism if you’re stopping people because they “look like illegal immigrants” and checking their identity. You might not think it’s racism if the person was indeed here without legal rights to be, but what about all of the people who will be stopped because they are Mexican, Latino, etc. who ARE here legally? You really want them to have to carry PROOF that they’re legal? Remember, only an AZ state issued DL counts as proof here, y’all.

3) What about all of those Latino folk who are here who ARE here legally, but are unable to provide proof? Forget your papers, you’re slapped with a misdemeanor. Ri-di-cu-lous.

4) Let’s pretend for a moment (a foolish moment) that this isn’t racism. The police aren’t actually targeting people who are Latino, they’re targeting people wearing tattered clothing and old shoes who HAPPEN to be Latino. Okay, now they’re classist AND racist. How is that okay to judge people by their income level and their appearance?

Have you SEEN a comment thread on an article or video about this issue? It is FILLED with people saying “This isn’t fucking racism, these goddamn brown people should get the hell out of our country. They’re taking our jobs (yeah, okay), they’re committing crimes (yeah, okay) and ruining my entire existence.” It is utter and complete hypocrisy.

I leave you with some quotes.

Oh precious privilege, that those who enjoy you are gracious enough to tell the rest of us what should or should not be offensive…what is or is not insulting and wrong and the very definition of unequal treatment under law.

But a bitch is gonna be a witness…the only race card on the table is this mandate of unequal treatment under law that is the new Arizona law.

The race card that says people of color, people with accents, people who wear “different” clothing or people who are conversing in a foreign language get to experience one kind of America while the rest of y’all get to expereince the other kind of America where your ass isn’t asked to prove your legal status when you’re pulled over for failing to yield.

There is no way to determine citizenship status by just looking at someone. So the officer must ask. And, in order not to run afoul of the equal protection clause, police will have to ask everyone.
So now what if our white driver, who does not speak with a foreign accent, refuses to answer the question? What will the officer do? The law says an Arizona’s driver’s license or state-issued ID card suffice as proof of citizenship. But what if the driver doesn’t have a driver’s license in his or her possession?

Can you imagine any scenario in which the officer would develop a “reasonable suspicion” that the white driver is in the country illegally? I can’t (if this was Vermont, I could).

Now change the white driver to a Hispanic driver. Is refusing to answer the question “reasonable suspicion?” Or is failure to have a driver’s license?

In a state with several hundred thousand illegal immigrants entering it every year, and several hundred thousand more living here, a reasonable person would have to argue that it is “reasonable suspicion.” But it’s reasonable suspicion based on race and that’s just not Constitutionally viable.
